Terms of Service for the Myne Browser

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING AND USING THE MYNE BROWSER, OR BY CLICKING “ACCEPT AND AGREE TO THE TERMS OF SERVICE” WHEN THIS OPTION IS MADE AVAILABLE TO YOU, YOU ACCEPT AND AGREE TO BE BOUND AND ABIDE BY THESE TERMS OF SERVICE. IF YOU DO NOT WANT TO AGREE TO THESE TERMS OF SERVICE, YOU MUST NOT ACCESS OR USE THE MYNE BROWSER AND NOT USE THE SERVICES.
NONE OF THE INFORMATION PROVIDED ON THE MYNE BROWSER CONSTITUTES INVESTMENT ADVICE, FINANCIAL ADVICE, TRADING ADVICE, LEGAL ADVICE, OR ANY OTHER SORT OF ADVICE, AND YOU SHOULD NOT TREAT ANY OF THE MYNE BROWSER’S CONTENT AS SUCH.
1. Introduction
These terms of service (“Terms”) are entered into by and between you (“you”, “your” or “User”) and Visionaire Capital AG, c/o Wadsack Zug AG, Bahnhofstrasse 7, 6300 Zug, Switzerland (“we”, “us” or “Visionaire”). These Terms, including the Privacy Notice, apply to your access or use of the Myne Browser and its features (https://mynebrowser.com/; collectively “Myne Browser”).
We reserve the right to modify these Terms at any time at our sole discretion. In this case, we will provide notice by changing the “last updated” date above. By continuing to access or use the Myne Browser, you confirm that you accept these updated Terms and all documents incorporated therein by reference. If you do not agree with these Terms, please immediately cease all access or use of the Myne Browser.
2. Eligibility
By accessing or using the Myne Browser, you represent and warrant that you:
- have the right, authority, legal capacity and legal age to accept these Terms;
- will not access or use the Myne Browser if the laws of your countries of residency and/or citizenship prohibit you from doing so in accordance with these Terms,
- are not subject to personal sanctions issued by the UN, US, EU or Switzerland;
- only access or use the Myne Browser for your own personal use (commercial use is prohibited); and
- are not accessing or using the Myne Browser from one of the countries embargoed or restricted by the Swiss State Secretariat for Economic Affairs (SECO), including, but not limited to: Belarus, Burundi, Central African Republic, Congo, DPRK (North Korea), Guinea, Guinea-Bissau, Iran, Iraq, Lebanon, Libya, Mali, Myanmar (Burma), Republic of South Sudan, Russia, Somalia, Sudan, Syria, Ukraine, Venezuela, Yemen, or Zimbabwe (“Prohibited Jurisdictions”).
The restrictions outlined in this section can be enforced using technical measures such as geo-blocking, as well as wallet and transaction screening.
Certain features and functionalities may be restricted based on age, jurisdiction, or other eligibility requirements.
3. Myne Browser
3.1 Overview
The Myne Browser is a Chromium-based browser that can be used without creating a user account and is designed to provide a privacy-focused browsing experience with integrated AI-assisted functionalities (“Myne Browser”).
The Myne Browser is designed to support user control over browsing context, preferences and data flows. User data, including browsing history, bookmarks, preferences, chats and user memory, are stored locally on your device and in encrypted form.
The Myne Browser may include, now or in the future, features such as AI-assisted browsing and search, context-aware assistants capable of supporting multi-step or autonomous task chains, ad-blocking, tracker-blocking, user-controlled data deletion, community features, rewards, premium features and wallet-related functionalities. The availability of such features may vary depending on your location, device, browser version, account status or other factors.
3.2 Content
You may provide input to the Myne Browser (“Input”) and receive outputs generated on the basis of such Input (“Output”). Input and Output are collectively referred to as “Content”.
The Myne Browser may index or display publicly available information and content provided by third parties as Content. Such Content is provided for general informational purposes only. You are solely responsible for your Content, including for ensuring that it complies with applicable law and these Terms. You represent and warrant that you have all rights, licences and permissions necessary to provide any Input to the Myne Browser and its services.
We do not control, verify or endorse Content, third-party information and content, websites, services, products or information that may be accessible through the Myne Browser.
3.3 User Account and Connected Wallet
The standard functionalities of the Myne Browser may be accessed and used without creating a user account or connecting a third-party wallet.
Certain features and functionalities of the Myne Browser, including, for example, the AI-Assisted Features (see Section 3.4) or the Community and Reward Features (see Section 3.6), require you to create and maintain an account in accordance with these Terms (“User Account”). The Myne Browser will indicate before you access or use a feature whether a User Account is required.
Additionally, certain features and functionalities, including, for example, the Community and Reward Features (see Section 3.6), require you to connect a compatible third-party wallet to your User Account as specified by us from time to time (“Connected Wallet”). The Myne Browser will indicate before you access or use a feature whether a Connected Wallet is required.
When creating a User Account and/or connecting a Connected Wallet, you are responsible for (a) providing complete and accurate information and communicating any changes, (b) maintaining the security of your User Account and/or your Connected Wallet, (с) keeping your account and/or wallet credentials confidential and (d) all activities carried out through your User Account and/or Connected Wallet.
We cannot be held responsible for any damage resulting from inaccurate or outdated information. Further, you must notify us promptly (and in any event no later than 2 days) of any unauthorized use or security breach of your User Account and/or Connected Wallet. You acknowledge that a loss of your credentials may result in the loss of all your data and tokens. We shall not be liable for any unauthorized access to your User Account and/or Connected Wallet and have no obligation to replace any data or tokens that are lost or rendered inaccessible because of such unauthorized access, or to otherwise compensate you for any damages or losses that occurred.
We may verify User Account information, wallet ownership, and other information relevant to your access and use of the Myne Browser. We may refuse, suspend or restrict the creation of a User Account or the connection of a third-party wallet where this is necessary to protect the integrity, security or proper operation of the Myne Browser.
You are not allowed to maintain multiple User Accounts. Your User Account is personal to you and may not be sold, transferred and assigned to, or shared with relatives, friends or others, or used by you for any commercial purposes.
3.4 AI-Assisted Features
The Myne Browser may provide AI-assisted search, summaries, recommendations, generated content, task execution support, or other AI-based functionalities. Such features are intended to support your browsing experience only.
Certain AI or voice-related functionalities may rely on dedicated third-party inference or service providers. Where such providers are used, we will seek to ensure that user data is not used by such providers for training purposes, subject to the applicable contractual and technical arrangements.
3.5 Feedback Form
The Myne Browser may include a built-in feedback feature that allows you to submit feedback, comments, suggestions or bug reports directly to us.
By submitting feedback, you acknowledge that we may use such feedback to review, improve, test, maintain and develop the Myne Browser and related services. You understand that we may use your feedback, comments, suggestions or bug reports without any obligation to compensate you for them.
Please do not submit confidential information or personal data that is not necessary for your feedback request.
3.6 Community and Reward Features
The Myne Browser may provide access to reward and community features, including tasks, ranks, ambassador roles, reward mechanisms and user progression features. Where we offer participation models through which users may receive benefits or rewards in connection with user-generated value, participation will be voluntary and subject to the applicable terms of service, consent requirements and eligibility criteria.
3.7 Testing and Early Access Features
Certain features of the Myne Browser may be made available on an alpha, beta, preview, testing or early-access basis. Such features may be incomplete, may contain errors or may be changed, suspended or discontinued at any time.
You acknowledge that testing and early-access features are provided on an “as is” and “as available” basis and may not be suitable for production, business-critical or security-sensitive use. We expressly disclaim all warranties or conditions of any kind, whether express, implied, statutory or otherwise.
3.8 Fees
The Myne Browser and its features and functionalities are generally available free of charge.
We reserve the right, at our sole discretion, to introduce subscription plans or charge fees for certain features or functionalities in the future. Any applicable fees and payment terms will be communicated to you before you subscribe to or use the relevant paid feature or functionality.
3.9 Taxes
You are solely responsible for obtaining tax advice and complying with all applicable tax laws in any jurisdiction. You must bear and pay any taxes, fees, or charges arising from your access or use of the Myne Browser or its subscriptions, including withholding tax, VAT, and income tax. You agree to indemnify and hold us harmless from any liability resulting from your failure to do so.
3.10 Additional Terms of Service
Certain features or functionalities of the Myne Browser may be subject to additional or separate terms of service. Where applicable, we will make such terms of service available to you before you access or use the relevant feature or functionality and may require you to accept them separately. In the event of any conflict between these Terms and such additional or separate terms, the latter shall prevail with respect to the relevant feature or functionality.
4. Availability of the Myne Browser
We are always trying to improve the Myne Browser. That means we may add or remove features, functionalities, and the support of certain devices and platforms. The Myne Browser may be interrupted, including for maintenance, repairs, upgrades, or network or equipment failures. We may discontinue features of the Myne Browser and the support for certain devices and platforms. Events beyond our control may affect the Myne Browser, such as events in nature and other force majeure events, including changes in applicable regulation that prohibit the Myne Browser, acts of God, fire, flood, explosion, wars, terrorism, riots, cyber incidents, civil disturbances and strikes, or other work stoppages, technological change, changes in interest rates or other monetary conditions; and for the avoidance of doubt, changes to any distributed ledger network-related protocol.
5. Intellectual Property Rights
We retain all right, title and interest in all its intellectual property, including, without limitation, inventions, ideas, concepts, code, discoveries, processes, marks, methods, software, compositions, formulae, techniques, information, and data, whether or not patentable, copyrightable or protectable in trademark, and any trademarks, copyright or patents based thereon.
Neither these Terms nor the access or the use of the Myne Browser shall be construed as granting, transferring, assigning, or conferring, by implication or otherwise, any license, title, or other right in or to any intellectual property, proprietary technology, any software, source code, object code, documentation, or related intellectual property owned by us.
6. Third-Party Software and Open Source Software
The Myne Browser may include third-party software, including open-source software components. Your use of any such third-party software is subject to the applicable third-party license terms. To the extent required by those license terms, the relevant notices, attribution information and license texts will be made available to you.
7. Third-Party Links
Certain features of the Myne Browser may require you to access or visit a third-party website or application which is not owned, controlled, managed or operated by us. We do not take responsibility for the content or the practices of a third-party website or application. This redirection or inclusion of a linked third-party website or application in the Myne Browser in no way implies any endorsement from us of a linked third-party website’s or application’s content, advertisers or sponsors. If you link to or use such third-party website or application, you do so at your own risk. If you believe that any third-party website or application include or promote illegal, harmful, fraudulent, infringing, obscene, defamatory, threatening, intimidating, harassing, hateful, racially, ethnically or otherwise offensive content, please contact us via legal@mynebrowser.ai so that we can remove any such third-party website or application from the Myne Browser.
8. Permitted Use and Prohibited Conduct
You may access or use the Myne Browser only for lawful and authorized purposes. You must not: (i) violate any rights, including privacy, publicity, intellectual property, or proprietary rights; (ii) engage in illegal, obscene, defamatory, threatening, harassing, hateful, or discriminatory conduct, or encourage such conduct; (iii) publish false, misleading, or fraudulent information or impersonate any person; (iv) access or use the Myne Browser for terrorist financing, unlawful transactions, or unauthorized commercial purposes; (v) access, use, copy, modify, distribute, or exploit the Myne Browser in any unauthorized manner, including: (a) reverse engineering, decompiling, or extracting code, (b) transmitting viruses or harmful code, (с) gaining unauthorized access or interfering with security or performance (d) collecting participant information without consent, (e) selling, sublicensing, or distributing the Myne Browser without authorization, (f) removing or altering intellectual property notices, (g) creating software or APIs that replicate the Myne Browser’s functionality.
9. Warranty Disclaimers
The access or use of the Myne Browser is made at your own risk. You understand and agree that the Myne Browser is provided on an “as is” and “as available” basis and that we expressly disclaim all warranties or conditions of any kind, whether express, implied, statutory or otherwise.
Neither we nor any person associated with us makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the Myne Browser. Without limiting the foregoing, neither we nor anyone associated with us (MYNE Parties, as defined below) represents or warrants that the Myne Browser, its outputs, or any services obtained through the Myne Browser (if any) will be accurate, reliable, error-free, or uninterrupted, that defects will be corrected, that the Myne Browser or the server that makes it available are free of viruses or other harmful components, or that the Myne Browser, its output or any services or items obtained through the Myne Browser (if any) will otherwise meet your needs or expectations.
10. Indemnification
To the fullest extent permitted by applicable law, you will indemnify, defend and hold harmless us, our respective past, present and future employees, officers, directors, contractors, consultants, equity holders, suppliers, vendors, service providers, parent companies, subsidiaries, affiliates, agents, representatives, predecessors, successors and assigns (“MYNE Parties”) from and against all claims, demands, actions, damages, losses, costs and expenses (including attorneys’ fees) that arise from or relate to: (a) your responsibilities or obligations under these Terms; (b) your violation of these Terms; or (с) your violation of any rights of any other person or entity; (d) and any dispute between you and any other person accessing or using the Myne Browser.
11. Limitation of Liability
To the fullest extent permitted by law, in no event shall we and the MYNE Parties be liable for damages of any kind, under any legal theory, arising out of or in connection with your access or use of the Myne Browser, any websites linked to it, any content of such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.
You further understand and agree that neither the underlying blockchain nor any of its implementations and/or components are under the control of and/or operated by us and that we shall not be liable for any loss or injury resulting from any vulnerability or any type of malfunction or failure of the underlying blockchain or any other issues resulting in loss or injury.
12. Risks
The Myne Browser may use artificial intelligence (“AI”) features to provide search results, summaries, recommendations, generated content or other Content. AI-generated Content may be incomplete, inaccurate, outdated, misleading, biased or otherwise inappropriate. In particular, AI systems may generate incorrect information, including so-called “hallucinations”, and may not reflect all relevant facts, legal requirements or current developments.
You are solely responsible for reviewing and independently verifying any AI-generated Content before relying on it or using it for personal, commercial, legal, financial, medical, technical or other purposes. AI-generated Content does not constitute professional advice and must not be relied upon as a substitute for independent judgment or professional advice.
We do not guarantee the accuracy, completeness, reliability, availability or suitability of any AI-generated Content. Neither we nor the MYNE Parties shall be liable for any decisions, actions, omissions, losses, damages, costs or expenses arising from or in connection with your use of, reliance on or inability to use any AI-generated Content.
13. Termination
Although we hope you remain a user of the Myne Browser, you can terminate your relationship with us anytime for any reason by uninstalling your copy of the Myne Browser.
We may modify, suspend, or terminate your access or use of the Myne Browser anytime without reason. We may take any legal or administrative action, including criminal prosecution, at our sole discretion for suspicious or unlawful conduct, including for fraud and other actions set out in Section 8 or if we reasonably believe you violate these Terms or create harm, risk, or possible legal exposure for us, our users, or others.
We may deactivate the Myne Browser at any time. In that event, your access to and use of the Myne Browser will cease.

15. Feedback
We always appreciate your feedback or other suggestions about the Myne Browser, but you understand that you have no obligation to provide feedback or suggestions and that we may use your feedback or suggestions without any obligation to compensate you for them.
16. Miscellaneous
16.1 Independent Contractors
These Terms do not create a principal or agent, employer or employee partnership, joint venture, or any other relationship except that of independent contractors between the parties. Nothing contained herein shall be construed to create or imply a joint venture, principal and agent, employer or employee, simple partnership, or any other relationship except that of independent contractors between the parties, and neither party shall have any right, power or authority to create any obligation, express or implied, on behalf of the other in connection with the performance hereunder.
16.2 Assignments and Transfers
These Terms, including any rights and obligations contained herein, cannot be assigned or transferred by you in whole or in part without our previous written consent. Any assignment or transfer that does not conform with the terms of this provision shall be void.
We are entitled to assign or transfer these Terms in whole or in part to any other entity. You hereby expressly acknowledge and agree to such assignment and assumption and, if the Terms are assigned by us, release us from any and all obligations or other duties arising out of these Terms.
16.3 Severability
If any provision of these Terms should be invalid in any jurisdiction under applicable law, the legality and enforceability of the remaining provisions hereof shall not in any way be affected or impaired thereby. In such an event, the parties commit themselves to compose a legally valid replacement rule which approaches the invalid provision as closely as possible within the economic intent of these Terms. These Terms will be interpreted as though the invalid clause had been omitted from the outset.
16.4 No Waiver
If any party of these Terms waives the enforcement or exercise of its contractual right in a particular case, this may not be considered a general waiver of the respective right or any other contractual right or the exercise and enforcement thereof.
16.5 Reservation of Rights and Mandatory Statutory Rights
We reserve all rights not expressly granted to you. In certain jurisdictions, you may have legal rights as a consumer, and these Terms are not intended to limit such consumer legal rights that may not be waived by contract. Also, in certain jurisdictions, you may have legal rights as a data subject, and these Terms are not intended to limit such rights that may not be waived by contract.
16.6 Governing Law and Venue
These Terms and all claims relating to or arising out of these Terms, or the breach thereof, whether in contract, tort or otherwise, shall be governed by Swiss Law, excluding Swiss choice-of-law principles. The United Nations Convention for the International Sales of Goods is excluded.
Any dispute arising out of or relating to these Terms or its subject matter or formation (including non-contractual disputes or claims) will be resolved by the ordinary courts of the city of Zug, Switzerland.
